Terms of Service

1. Introduction

These Terms of Service (“Terms”) set out the agreement between Louise Tod Design (“I”, “me”, “my”) and the client (“you”). By booking any services, you agree to these Terms. These Terms are governed by the laws of England and Wales.

2. Services Provided

I offer website design and related services, which may include:

Website design and layout
Website builds on platforms such as Wix, Squarespace, or WordPress
Content formatting and basic SEO setup
Training or handover documentation
Ongoing support (if agreed separately)

A full description of your project will be confirmed in writing before work begins.

3. Client Responsibilities

You agree to:

Provide all required content (text, images, branding assets) promptly
Ensure you have the legal right to use any content you supply
Respond to feedback requests and approvals within agreed timeframes
Provide accurate information needed to complete the project

Delays in providing content or feedback may extend the project timeline.

4. Project Timeline

I will provide an estimated timeline for your project. Timelines may change if:

You request additional work
Content or approvals are delayed
Technical issues arise outside my control (e.g., platform outages)

5. Revisions

Unless otherwise stated, projects include two rounds of revisions. Additional revisions or changes outside the original scope may incur extra charges, which will be agreed in advance.

6. Payments

A deposit (to be agreed depending on the scope of the project) is required to secure your project.
The remaining balance is due upon completion.
Payments must be made via bank transfer.
Late payments may result in paused work until payment is received.

7. Cancellations & Refunds

If you cancel before work begins, your deposit may be refundable at my discretion.
If you cancel after work has started, the deposit is non‑refundable and you may be charged for work completed to date.
If I must cancel due to unforeseen circumstances, you will receive a refund for any work not yet completed.

8. Intellectual Property

You retain ownership of any content you provide.
I retain ownership of my design work until full payment is received.
After full payment, you receive a licence to use the completed website for your business.
I may showcase the project in my portfolio unless you request otherwise in writing.

9. Third‑Party Services

Your website may rely on third‑party services (e.g., hosting, domain providers, plugins, apps).
I am not responsible for:

Changes made by third‑party providers
Outages, performance issues, or price changes
Ongoing maintenance unless agreed separately

You are responsible for any ongoing subscription fees.

10. Website Handover

Once the project is complete and paid for, I will provide:

Access to your website
Any agreed training or documentation
A final review to ensure everything is functioning as expected

After handover, you are responsible for maintaining your website unless you have purchased a support package.

11. Limitation of Liability

I will not be liable for:

Loss of profits, revenue, or data
Business interruption
Issues caused by third‑party platforms, hosting providers, or plugins
Changes you make to the website after handover

My total liability will not exceed the amount you paid for the project.

12. Confidentiality

Both parties agree to keep confidential any sensitive information shared during the project.

13. Data Protection

I comply with UK GDPR and will only use your personal data to manage your project and communicate with you. You are responsible for ensuring your website complies with data protection laws, including having a Privacy Policy and Cookie Notice.

14. Changes to These Terms

I may update these Terms from time to time. The version in place at the time of booking will apply to your project.
